1. Introduction
These Terms of Service govern the use of the website and services provided by Utāb Studio.
By accessing this website, booking a photography session, or using our services, you agree to be bound by these Terms.
If you do not agree with these Terms, please refrain from using our website or services.
2. Services
Utāb Studio provides professional photography services, including but not limited to:
Portrait photography
Personal and private photo sessions
Branding and commercial photography
Other photography services as agreed upon in writing
The scope, deliverables, pricing, and timeline of each assignment are defined in a separate agreement or booking confirmation.
3. Booking and Payment
All bookings are subject to availability and confirmation by Utāb Studio.
Prices are communicated prior to the session and confirmed in writing.
Payment must be made via the agreed payment method (e.g. Vipps, invoice, or other).
Unless otherwise agreed, payment is due before image delivery.
Utāb Studio reserves the right to cancel or reschedule sessions due to unforeseen circumstances such as illness, technical failure, or force majeure.
4. Delivery of Images
Final images are delivered digitally via Pic-Time online gallery.
Images are delivered as edited, high-resolution JPEG files unless otherwise agreed.
RAW files are not delivered unless explicitly agreed in writing.
Delivery time is agreed upon prior to or shortly after the photography session.
Utāb Studio retains the right to artistic discretion in editing style and image selection.
5. Storage and Archiving
Delivered images are stored for up to 12 months after final delivery.
RAW files are stored only temporarily and may be deleted shortly after selection and editing.
After the storage period expires, Utāb Studio is not responsible for file recovery.
Clients are responsible for downloading and securely storing their images.
6. Copyright and Usage Rights
All images are protected under copyright law.
Utāb Studio retains full copyright to all images.
Clients are granted a personal, non-commercial license to use the images unless otherwise agreed in writing.
Images may not be sold, altered, used commercially, or transferred to third parties without written permission.
Commercial usage requires a separate licensing agreement.
7. Marketing and Publication
Images may only be used by Utāb Studio for marketing, portfolio, website, or social media purposes with explicit written consent from the client.
Clients may withdraw consent at any time. Withdrawal does not affect content already published prior to withdrawal.
8. Client Responsibilities
Clients agree to:
Provide accurate and complete information when booking
Arrive on time for scheduled sessions
Inform Utāb Studio of any specific requirements or restrictions in advance
Delays caused by the client may reduce session time without refund unless otherwise agreed.
9. Limitation of Liability
Utāb Studio shall not be held liable for:
Circumstances beyond reasonable control (force majeure)
Loss or damage caused by technical failure beyond reasonable precautions
Indirect or consequential damages
In any case, liability is limited to the amount paid for the specific service.
10. Privacy and Data Protection
Utāb Studio processes personal data in accordance with its Privacy Policy, which forms an integral part of these Terms.
11. Changes to the Terms
Utāb Studio reserves the right to update or modify these Terms at any time.
The most recent version will always be available on the website.
Continued use of the website or services constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by and interpreted in accordance with Norwegian law.
Any disputes shall be subject to the jurisdiction of Norwegian courts.
